Access to personnel files for Philadelphia delivery employees

personnel files for Philadelphia delivery employees: separating an offered inspection from a request for copies while identifying covered records and unresolved access questions.

Distinguish a personnel-file inspection request from a request for copies, keeping employment status, covered records and any correction dispute separate.

You ask an employer to email your performance evaluations and receive an offer to inspect records instead. Before treating that response as a refusal of access, separate the viewing request from the request for a copy. Questions about personnel files for Philadelphia delivery employees depend on the applicable law, the records involved and your employment status.

This guide explains that distinction under Pennsylvania’s Inspection of Employment Records Law. It does not establish an EPIQ records policy, decide an individual request or authorize access to another person’s information.

Request Pennsylvania personnel-file inspection

The Pennsylvania law defines an employee as someone currently employed, laid off with reemployment rights or on a leave of absence. It excludes job applicants. Do not assume this particular inspection route applies to everyone who has ever applied or worked for the employer.

Its personnel-file definition includes specified records if maintained by the employer, such as performance evaluations and attendance records. It also excludes categories, including medical records, reference letters and information available under the Fair Credit Reporting Act. “Everything the company knows about me” is not the statutory scope.

Identify the records you actually want and your reason for seeking them. If the employer requires a written request, use the applicable instructions and describe the relevant records or purpose accurately. Ask for clarification if the category you need is uncertain.

Distinguish inspection from copying or removal

The law provides inspection of covered personnel files at reasonable times under its conditions. Section 3 does not require the employer to permit removal or copying of the file; it permits notes.

You can ask whether a copy is available, but keep that request separate from inspection access. An employer’s offer of a viewing appointment does not, solely because it is not an emailed PDF, establish that inspection was denied. Equally, an appointment offer does not resolve every issue about access or the records made available.

Confirm where and how the inspection would occur. Keep the request and response together so you can explain what was offered and what remains unanswered. This guide does not supply a complete procedure or determine whether a particular arrangement meets the law.

Follow a fictional evaluation request

Suppose a fictional current employee asks for an emailed copy of their performance evaluations. The employer replies with an inspection appointment and asks the worker to identify the evaluation period of interest.

The worker’s note should show the requested evaluations, the separate copy request and the inspection arrangement offered. It should not compress the exchange into “employer refused my file” unless the facts support that description.

At the same time, the worker can ask whether the relevant evaluations will be available and whether copying is permitted. If the answer leaves access unclear, retain that specific question for follow-up. Neither the request nor the appointment establishes that an evaluation contains an error.

The employee and exchange are fictional. Eligibility and the adequacy of a real inspection arrangement require the actual facts.

Keep a record dispute separate from access

If you identify information you believe is wrong, describe the particular entry and the facts supporting your concern. Ask about the applicable response or correction process. Access to a record and changing what it says are different results.

Pennsylvania’s Department of Labor and Industry personnel-file page provides a contact and relief-request information for employees having difficulty obtaining access. Use the actual request and response when seeking help; do not assume an access complaint decides the merits of a performance disagreement.

Use the right record for the next question

You can use performance feedback for career development without treating a personal learning log as the employer’s official file. Keep any notes within permitted access and confidentiality boundaries.

If your issue concerns screening information, review a separate hiring background report through its appropriate route. Do not assume that asking for a personnel-file inspection obtains every third-party report or replaces its dispute process.

The Philadelphia delivery-work guides cover surrounding employment questions. For file access, retain the precise records requested and the actual inspection or copying response so the next discussion addresses the unresolved issue.
