Separate sick leave for Philadelphia delivery workers from shift coverage

Distinguish reporting a sick-time absence from a requirement to find a replacement, while keeping coverage questions and the actual leave record separate.

You report that you need sick time and receive a reply telling you to find another driver. Clarify whether the employer is making replacement coverage a condition of using the time. When asking about sick leave for Philadelphia delivery workers, keep the request and response available so the person helping you can see exactly what was said.

This guide addresses that distinction under Philadelphia’s sick-leave guidance. It does not determine an individual worker’s coverage, certify a particular absence or describe EPIQ Logistics’ policies. It also does not tell you to ignore an absence-reporting instruction or make a medical judgment about working.

Evaluate a sick time replacement condition

The City of Philadelphia lists wrongfully requesting an employee to find coverage in order to use sick time as a violation. Its page distinguishes paid leave at employers with 10 or more employees from unpaid leave at employers with nine or fewer.

The same page lists exemptions, including seasonal workers, people hired for less than six months, certain other worker categories and independent contractors. Non-probationary employees covered by a collective bargaining agreement and state or federal employees are also listed. Do not decide coverage from a delivery title, a company logo or one location’s apparent staffing level. The City directs questions about coverage or misclassification to its Office of Worker Protections.

Identify what the response requires

Read the absence instructions and the message you received. Identify the scheduled shift and the contact you notified. Then isolate the statement about another worker: is it explaining an optional swap, requesting information or saying sick time will not be recorded unless you obtain a replacement?

If the response is ambiguous, ask which action is required and how it relates to the sick-time request already made. A coworker’s offer to help does not establish what the employer requires, and an ordinary shift-swap discussion may leave the sick-time request unanswered.

Keep your clarification specific. For example: “I reported this as a request to use sick time for the scheduled shift. Are you saying I must find a replacement before that request can be processed?” Use your actual circumstances and the appropriate workplace contact. This is suggested wording, not a statement that a particular request must be approved.

Follow a fictional replacement condition

Suppose a fictional worker submits a sick-time request through the designated channel. A supervisor replies, “Find another driver before we can mark you off.” The worker has a copy of the submission but does not yet know whether the supervisor means an optional arrangement or a requirement.

The worker’s next note should retain both messages. It can identify the affected shift, when the request was sent and the unanswered question about the replacement condition. Rewriting the exchange simply as “shift swap pending” would lose the sick-time issue that needs clarification.

Now suppose a coworker volunteers to take the shift. That may help the staffing arrangement, but it does not explain the supervisor’s original condition or settle the worker’s leave record. Ask what the employer recorded and whether a response to the sick-time request remains outstanding.

This example does not establish eligibility, available earned time, a qualifying reason or a legal violation. It shows how a staffing conversation can leave the original leave question unresolved.

Keep the leave record separate from the roster

Ask how the absence and any use of sick time were recorded. If the roster changes, retain that update alongside the original request. Avoid assuming that a different name on the roster means your sick-time balance, pay or request status was handled correctly.

If there is a disagreement, use the actual messages and relevant records when seeking guidance. The City’s page identifies its Office of Worker Protections as a contact for questions and explains how to report a suspected violation. A saved message can support that discussion; it cannot by itself resolve every coverage or factual issue.

Use schedule and benefits information for their own questions

You can review the actual delivery work schedule to identify the shift affected. Its general pattern and swap arrangements do not settle a statutory sick-leave question. Likewise, compare the broader pay and benefits without treating a vacation policy as the complete explanation of sick time.

The Philadelphia delivery-work guides cover surrounding job decisions. When seeking help with this request, include the employer’s explanation of any replacement condition and identify the coverage or leave-record questions that remain unanswered.
